Welcome to Transport Hire Nepal. These Terms and Conditions (“Terms”) govern your use of our website, services, and vehicle rentals. By accessing our website, booking a vehicle, or utilizing our services, you agree to be bound by these Terms. Please read them carefully.
1.Definitions
- Company: “We, Us, Our: Refers to Transport Hire Nepal.
- Customer: “You, Your: Refers to any individual, group, or entity booking or using our services.
- Vehicle: Refers to any car, jeep, van, bus, coaster, or other mode of transport provided by Transport Hire Nepal.
- Driver: Refers to the professional driver provided by Transport Hire Nepal to operate the Vehicle.
- Service: Refers to vehicle hire, transportation, tour packages, and any other related offerings provided by Transport Hire Nepal.
- Booking: Refers to the reservation made by the Customer for a specific Vehicle and Service.
- Rental Period: The agreed-upon duration for which the Vehicle is hired.
- Website: Refers to the official website of Transport Hire Nepal.
2. Acceptance of Terms
By using our Website or making a Booking, you acknowledge that you have read, understood, and agree to these Terms and Conditions, our Privacy Policy, and any other policies referenced herein. If you do not agree with any part of these Terms, you must not use our services.
3. Booking and Confirmation
- Booking Process: All Bookings can be made through our Website, email, or by contacting us directly. You must provide accurate and complete information during the booking process.
- Advance Payment: To confirm your Booking, a 10% advance payment of the total rental charge is typically required, as specified during the booking process.
- Confirmation: Your Booking is confirmed only upon receipt of the advance payment and issuance of a booking confirmation/service voucher from Transport Hire Nepal.
- Availability: Vehicle availability is subject to change. While we strive to ensure the availability of your preferred Vehicle, we reserve the right to offer a suitable alternative if the requested Vehicle is unavailable due to unforeseen circumstances.
- Customized Trips: Customers may customize trips with our support. Any changes to the itinerary may incur additional charges.
4. Pricing and Payment
- Quoted Price: The price quoted for a Service will typically include vehicle rental, driver allowance, fuel, Tolls, parking fees, AC Usage, and standard road taxes, unless otherwise specified.
- Exclusions: Prices generally do not include:
- Customer entry fees to monuments, parks, or specific areas requiring permits.
- Accommodation and meals for the Customer (unless explicitly stated in a package).
- Any additional services not explicitly mentioned in the Booking confirmation.
Additional Charges:
- Route Changes/Extended Time: Any changes to the agreed route or extensions to the Rental Period must be communicated and approved by Transport Hire Nepal in advance. Additional charges will apply.
- Night Charges: Services utilized after 9:00 PM, may be subject to additional night charges.
- Disposal Rentals: Specific fees may apply for disposal services within certain areas (e.g., Kathmandu Ring Road) or between selected locations.
- Payment Methods: We accept major credit cards (Visa, MasterCard), debit cards, bank transfers, and digital wallets (eSewa, Khalti, etc.) as specified on our Website. Cash payments may be accepted at our office.
- Currency: All prices are typically quoted in Nepali Rupees (NPR), USD & INR. For international payments, conversion rates apply.
5. Cancellation and Rescheduling Policy
5.1 Cancellation by Customer
All cancellation requests must be submitted in writing via email to info@transporthirenepal.com or through the contact form on our official website. The applicable refund policy varies based on the nature of the booking:
- For Short-Distance Day Trips (any trip completed within one day with a limited travel distance, e.g., within a specific city or nearby accessible areas):
- Cancellations received 24 hours or more prior to the scheduled departure time are eligible for a full refund.
- Cancellations made less than 24 hours before the scheduled departure time, or in the case of a “no-show” by the customer, are non-refundable.
- For Long-Distance Day Trips, Round Trips, and Multi-Day Guided Tours (any trip involving significant travel distances or extending beyond one day):
- Cancellations received 15 days or more prior to the scheduled departure date are eligible for a full refund.
- Cancellations made less than 15 days prior to the scheduled departure date, or in the case of a “no-show” by the customer, are non-refundable.
5.2 Rescheduling Policy
We understand that plans can change. Customers wishing to reschedule their booking may do so free of charge, subject to vehicle availability. All rescheduling requests must be communicated as early as possible. We will endeavor to accommodate your preferred new tour date.
5.3 Refund Processing
Approved refunds will be processed to the original payment method within 7-10 business days of the cancellation approval. Please note that bank processing times may vary.
5.4 Cancellation and Contingencies by Transport Hire Nepal
5.4.1 Pre-Trip Cancellation by Transport Hire Nepal
Transport Hire Nepal reserves the right to cancel a confirmed booking prior to the commencement of the trip due to unforeseen circumstances beyond our control. Such circumstances include, but are not limited to, severe weather conditions, natural disasters, political unrest, road closures, or unavoidable vehicle breakdowns. In such instances, customers will be offered:
- A full refund of any payments made for the unfulfilled service, or the option to reschedule their trip to a mutually agreeable date, subject to vehicle availability.
- Transport Hire Nepal shall not be liable for any additional costs, losses, or damages incurred by the customer as a result of such pre-trip cancellations.
5.4.2 In-Trip Contingencies and Service Interruption
Should unforeseen circumstances, including but not limited to those listed in Section 5.4.1 (e.g., natural disasters, adverse weather conditions, political unrest, or significant vehicle issues), arise during an ongoing trip, Transport Hire Nepal will prioritize the safety and well-being of its customers.
Alternative Arrangements: We will endeavor to find the safest and most practical alternative solutions to continue the journey or ensure safe return, which may include rerouting or arranging alternative transportation.
Additional Costs: Any additional costs incurred due to such in-trip contingencies (e.g., extra mileage for rerouting, unexpected overnight stays, alternative transport arrangements) shall be borne by the customer. Transport Hire Nepal will provide transparent details of such costs and seek the customer’s agreement where feasible.
Refund for Unused Service: If a trip is significantly curtailed or cannot be completed due to such in-trip contingencies, Transport Hire Nepal will assess the unused portion of the service and discuss a partial refund or credit with the customer on a case-by-case basis, considering the specific conditions and causes.
5.5 Insurance Policy (Vehicles)
During road trips, all vehicles provided by Transport Hire Nepal are insured in accordance with the prevailing laws and regulations of the Government of Nepal. This insurance covers the vehicle itself as per standard third-party liability and comprehensive policies. Please note that this vehicle insurance does not cover personal accident or travel insurance for passengers. Customers are strongly advised to secure their own comprehensive travel insurance, including medical coverage, personal accident, and baggage insurance, prior to their trip.
Key improvements:
- Clarity on Pre-Trip vs. In-Trip: Clearly separates the policies for before the trip starts and during the trip.
- Defined Unforeseen Circumstances: Provides examples to give customers a better understanding.
- Customer Responsibility for In-Trip Costs: Explicitly states that additional costs for safety-related alternatives during a trip are borne by the customer, which is standard practice in such scenarios.
- Case-by-Case for In-Trip Refunds: Acknowledges that if a trip is cut short, a refund discussion will occur based on circumstances.
- Professional Language for Insurance:
- Specifies that vehicle insurance is as per Nepal government law.
- Crucially distinguishes that this does not cover passenger personal accident or travel insurance, urging customers to get their own. This is a very important point to avoid misunderstandings and potential liability issues for your company.
6. Vehicle Usage and Customer Responsibilities
- Driver Provided: All vehicles are provided with a professional and experienced driver. Self-driving is generally not permitted with our vehicles in Nepal.
- Permitted Use: The Vehicle is to be used solely for the purpose agreed upon in the Booking. It may not be used for:
- Racing, driving lessons, or sports training.
- Illegal activities or transportation of illegal goods.
- Any paid services not arranged through Transport Hire Nepal.
- Carrying more passengers than the vehicle’s stated capacity, including children.
- Compliance with Laws: Customers must comply with all local laws and regulations while using our Service. Should any illegal activities or actions outside the scope of our agreed service be discovered, the customer will bear full responsibility for any resulting costs, fines, penalties, or legal repercussions imposed by governmental authorities.
- Driver Instructions: Customers must not force the driver to break speed limits or violate traffic rules. Any fines incurred due to customer’s insistence will be the customer’s sole responsibility.
- Vehicle Condition: The Vehicle will be provided in good working condition with all necessary documents. In the event of a mechanical problem or accident during the trip, Transport Hire Nepal will endeavor to provide a replacement vehicle as soon as possible, without extra cost to the Customer, and the Customer must wait for its arrival.
- Return of Vehicle: Day return vehicles must be returned to their designated station on time. Late returns will incur extra charges.
- Damage to Vehicle: The Customer will be liable for any damage to the Vehicle caused by their negligence, misuse, or violation of these Terms, beyond normal wear and tear.
- Cross-Border Travel: Our rental vehicles are strictly for use within Nepal. Crossing international borders with a rental vehicle is prohibited unless specific arrangements and government approvals are obtained in advance.
7. Limitation of Liability
- Transport Hire Nepal acts as a facilitator connecting customers with vehicle services and experienced drivers.
- We are not liable for any losses or damages that were not reasonably foreseeable at the time of Booking or entering into these Terms.
- We are not liable for any event that was reasonably beyond our control (Force Majeure, as defined below).
- We are not responsible for any loss or damage to personal belongings left in the Vehicle. Customers are advised to ensure they have all their belongings when exiting the vehicle.
- While we strive for punctuality, we are not liable for delays caused by traffic, road conditions, political unrest, or other unforeseen circumstances.
8. Force Majeure
- Neither party shall be held liable for any loss or damage incurred due to circumstances or contingencies beyond their control, including but not limited to natural disasters, acts of government, war, terrorism, civil unrest, strikes, or major transportation disruptions. The party affected by Force Majeure shall use its best efforts to resume its Services as soon as possible.
9. Privacy Policy
- Your personal information collected during the booking process will be handled in accordance with our Privacy Policy, which is available on our Website. We are committed to protecting your privacy and will only share your information with service providers on a need-to-know basis to fulfill your Booking.
10. Intellectual Property
- All content on our Website, including text, graphics, logos, images, and software, is the property of Transport Hire Nepal or its content suppliers and is protected by copyright and intellectual property laws. You may not monitor, copy, scrape/crawl, download, reproduce, or otherwise use anything on our Website for any commercial purpose without our express written permission.
11. Indemnification
- You agree to indemnify, defend, and hold harmless Transport Hire Nepal, its directors, employees, and agents from and against all lawsuits, liabilities, damages, losses, and costs (including reasonable legal fees) incurred as a result of your failure to act by these Terms and Conditions or your misuse of our Services.
12. Governing Law and Jurisdiction
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
13. Severability
- If any provision, or part of a provision, contained in these Terms is found by any court or relevant authority to be unlawful, invalid, or unenforceable, the remaining provisions, or part of that provision, shall not be affected and will remain in full force and effect.
14. Amendments to Terms
- Transport Hire Nepal reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our Website with an updated “Effective Date.” Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
